the stats, appearance and names of the gear dropped by the emperor are randomized therefore it is possible for this to happen, as there are so many variations, usually it wouldnt be so obvious however on this occasion you have what would appear to be 2 identical items with different stats attached to them

You will find it is the same in any game with random item drops, I remember my Diablo account having exact copies of the same items by name and design but with different stats, same in Team Fortress 2 when they introduced weapon drops, same item different stats, Random means random, sometimes you will get this and sometimes you won't, if you dont like the stats on them then break them up so you can level up the ones you DO like the stats on :)
How? This game claimed to be "strategic" cannot be "random". Imagine online chess game. You have a tower vs an opponent's pawn. But all of the sudden, the pawn beats your tower and game providers insist that they have nothing to do with it, because the power is "random". that is ridiculous.
