Not really sure what you mean - you often end up unable to kill your opponent, but not getting killed either? You'll just have to improve your team or choose battles more wisely, then - with all the advantages the attacker has in terms of being able to pick his battles and adjust his team beforehand based on the defender's team, it's only fair that he has to take the loss if he doesn't manage to kill the defender.
